As many have already noted, intent is not a requirement in this case, just as it wasn’t for Hilarious when Comey gave her a pass.

Does anyone else find it kind of weird that right now, just right now, Biden is finding himself in trouble? After EVERYTHING, from Afghanistan, to so many vacations I can’t remember, to “the border is secure”, to the Angry Brandon speech, it’s right NOW that Paul Begala, David “Axe” Axelrod and even Hillary herself are saying that just maybe there’s a real problem with Joe. The Democrats in the back rooms who are responsible for him winning over Sanders are driving that bus. There does seem to be a pattern of Dems pulling out the long knives when an inconvenient problem threatens to drag down a candidate and said candidate doesn’t sudden have an urge to spend more time with his family.

Oh (yeah, another “Oh”) and yesterday the Vice President of the United States of America, Kamala Harris, announces that she’s ‘ready’* if necessary to serve as President if required. Was that a signal to either Joe or the DNC that Gavin Newsom being placed ahead of Kamala, a white guy being selected by the DNC over a woman of color, who happens to be current VP, that move would be considered very very bad form, and no doubt racist and misogynist, if Joe were to step aside post convention, for health reasons?

Kennedy had a Super Bowl commercial as an Independent. Michelle would only want a coronation. An election is too, … , common. That leaves Gavin, who can’t run on his record as governor. Can he?

I can’t believe that Steve and Bill let Scott get away with sugar-coating the crimes that Biden has committed. There is no reference to INTENT in the statute, that makes mishandling classified documents a crime! And, no vice-president, never mind a senator, has any right to tote off classified documents! The poppycock at the heart of this segment (supplied by Scott) makes this one of your very weakest shows.

The president has the privilege to declassify. Not the Vice President. Having those docs in his garage and the Penn Center was wrong, period. Should have been at the archives at the end of his term.

  1. The legal principle protectng Beijing Biden is “competency.” So, the Demonrats are forced into saying that he’s incompetent to defend himself from accountability for wrongdoing, but completely competent to run the country. Amazing. LOL
  2. Culpability for mishandling of classified documents does not depend on intent. If I had done what Clinton or Biden had done, I’d STILL be making little rocks out of big ones. Having such responsibility imparts absolute liability.

No, Scott. Intent is not an element of the crime. No person other than the President may hold classified material outside of a SCIF. Not a Vice President, not a Senator, not anyone on a Vice President’s or Senator’s staff. Biden is openly admitted to have taken and held classified documents both while a Senator and while Vice President. If we lived in a nation of laws, he would be prosecuted.

Vice President is not allowed to possess Classified Materials! Only the President is, and many of the sensitive materials Biden possesses were actually obtained by him during his Senate tenure, when her REALLY doesn’t have such authority!!!
