As many have already noted, intent is not a requirement in this case, just as it wasn’t for Hilarious when Comey gave her a pass.
Does anyone else find it kind of weird that right now, just right now, Biden is finding himself in trouble? After EVERYTHING, from Afghanistan, to so many vacations I can’t remember, to “the border is secure”, to the Angry Brandon speech, it’s right NOW that Paul Begala, David “Axe” Axelrod and even Hillary herself are saying that just maybe there’s a real problem with Joe. They’re saying age, not dementia, as if everyone at his age exhibits these characteristics….as in Yeah, Joe’s old, BUT SO IS TRUMP! Joe threw his staff under the bus. Who, right now, is throwing Joe… Read more »
The Democrats in the back rooms who are responsible for him winning over Sanders are driving that bus. There does seem to be a pattern of Dems pulling out the long knives when an inconvenient problem threatens to drag down a candidate and said candidate doesn’t sudden have an urge to spend more time with his family.
Oh (yeah, another “Oh”) and yesterday the Vice President of the United States of America, Kamala Harris, announces that she’s ‘ready’* if necessary to serve as President if required. Was that a signal to either Joe or the DNC that Gavin Newsom being placed ahead of Kamala, a white guy being selected by the DNC over a woman of color, who happens to be current VP, that move would be considered very very bad form, and no doubt racist and misogynist, if Joe were to step aside post convention, for health reasons?

Kennedy had a Super Bowl commercial as an Independent. Michelle would only want a coronation. An election is too, … , common. That leaves Gavin, who can’t run on his record as governor. Can he?
He thinks he can. Maybe has dementia too?😊 Or just plain insanity.
I can’t believe that Steve and Bill let Scott get away with sugar-coating the crimes that Biden has committed. There is no reference to INTENT in the statute, that makes mishandling classified documents a crime! And, no vice-president, never mind a senator, has any right to tote off classified documents! The poppycock at the heart of this segment (supplied by Scott) makes this one of your very weakest shows.
18 U.S. Code sec 793 (f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its… Read more »
The president has the privilege to declassify. Not the Vice President. Having those docs in his garage and the Penn Center was wrong, period. Should have been at the archives at the end of his term.
No, Scott. Intent is not an element of the crime. No person other than the President may hold classified material outside of a SCIF. Not a Vice President, not a Senator, not anyone on a Vice President’s or Senator’s staff. Biden is openly admitted to have taken and held classified documents both while a Senator and while Vice President. If we lived in a nation of laws, he would be prosecuted.
Y’all talk about intent. I’m pretty sure, Comey’s dereliction notwithstanding, this is a strict-liability crime. Mens Rea doens’t apply.
I’m not joining in the ‘it’s so sad’ chorus , Biden’s always been a miserable nasty SOB. Remember in the debate when he kept talking over Paul Ryan and never letting him make coherent point.
Vice President is not allowed to possess Classified Materials! Only the President is, and many of the sensitive materials Biden possesses were actually obtained by him during his Senate tenure, when her REALLY doesn’t have such authority!!!
Scott is either lying or stupid. The taking of classified documents has NEVER required intent. Just ask the many military who mistakenly took or misplaced classified that are now in jail for mishandling classified. Reasonable doubt is always a possibility. You never know when so stupid liberal little ole lady or man employees jury nullification to get even with society and hold out for conviction.
I don’t think Scott is either lying OR stupid. However, ignorance is still on the table.
Like that “little ole lady” you reference, Scott often looks at humanity through rose-colored glasses, willing to give benefit of the doubt. In this case, too many have successfully whitewashed Creepy Joe’s bad (criminal?) behavior to the point that he has become the ideal scapegoat for the Left’s continued crimes against humanity. It’s all a distraction from the wizard behind the curtain — throw the meat puppet to the wolves.
Good enough, I left out ignorance, which is fixable with truth. But stupid is forever.
Very true. No amount of duct tape can fix it.
Mistaken, or maybe they really did rewrite the universal meaning of intent for just this statute? Without looking at the statute, as a rule you only need intend to do the act. Ignorance of the law is never an excuse, other wise we’d have lawlessness–at least that’s how it was explained to my class in paralegal school in 2008. So he intended to remove the documents, that’s the intent. That’s higher on the “intent ladder” than willfull/wanton disregard.
I disagree on the ignorance part, laws must be written to be understandable by the average person, todays 4000 word behemoths are not understandable to anybody, with clauses and refer backs to obscure regulations hidden in all over the place
However, THIS statute is clear as crystal!
